FTC Will Hold Public Workshop on Section 5 Unfair Methods of Competition
On October 17, 2008, the U.S. Federal Trade Commission will hold a public workshop in Washington, D.C., to explore the scope of the prohibition of "unfair methods of competition" in Section 5 of the Federal Trade Commission Act. The workshop will focus on unlawful conduct that is not covered by the Sherman Act and other antitrust laws. The FTC seeks written and oral comments at the workshop on the following topics:

    (1) the history of Section 5, including Congress's enactment, the FTC's enforcement, and the courts' response; (2) the range of possible interpretations of Section 5; and (3) examples of business conduct that may be unfair methods of competition addressable by Section 5.

Written comments are due to the FTC by October 24, 2008.

    OMB Requires Agencies To Release FY 2008 Performance and Financial Reports
    All major agencies must produce a two-page snapshot of their performance and financial results for fiscal 2008 to improve annual reporting, the Office of Management and Budget said in guidance released Aug. 29. OMB also provided an online template to help agencies create the snapshots, which they must finalize by Dec. 15, the memo states. OMB said it plans to publish a governmentwide performance results report in January 2009.
